Prices of goods and services and delivery and other charges displayed on the Lensplanet.com website are current at the time of display.
These prices are subject to variation without notice. We will always attempt to be as accurate as possible with our product descriptions and pricing. However, we are unable to warrant that product descriptions or other content of the website is accurate, complete, reliable, current or error free. However, once an order is placed, that price will apply even if the rates change before delivery.
COLOUR AND PRODUCT DESCRIPTION
We have made every effort to display as accurately as possible the colors of our products that appear at the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate. We have attempted to be as accurate as possible. However, we do not warrant that the product descriptions are accurate, complete, reliable, current, or error-free.
If a product offered by the Site is not as described, your sole remedy is to return it in unused condition. To the fullest extent permitted by applicable law, Lensplanet.com disclaims all representations and warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose and non-infringement. Lensplanet.com makes no warranty that this website, any information or ideas contained on this website or any products or services will meet your requirements.
You expressly acknowledge and agree that Lensplanet.com does not control other users of this website, the providers of information or ideas to this website or the suppliers of goods and services purchased from this website, and Lensplanet.com is therefore not liable for their opinions or their behaviour, including any information or advice provided by them or any defamatory statements made by them or any offensive conduct on their part. You further acknowledge and agree that, subject to the section dealing with "Limitation of Liability", Lensplanet.com will not be liable to you or any other person for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for product liability, personal injury or negligence resulting from use of goods or services supplied to you, or on behalf of you, through the website.
You hereby certify that you hold a valid prescription for the contact lenses you wish to order. This means that your prescription is within 12 months from the date of purchase and that the prescription has been dispensed by a professional and qualified optometrist.
LIMITATION OF LIABILITY
Without limiting the operation of any other Terms and Conditions herein, Lensplanet.com is not responsible for any loss or damage caused by late delivery or cancellation of an order or a product. We reserve the right not to provide goods or services, terminate membership accounts, remove or edit content or cancel orders (or part thereof) at our sole discretion at any time. Without limiting the operation of any other Terms and Conditions herein, we will not be held liable for loss or damage arising from the exercising of these rights.
Any liability of Lensplanet.com or Lensplanet.com's Associates in connection with goods or services supplied to you will, subject to any non-excludable liability for breach of conditions or warranties implied by legislation and to the maximum extent permitted by law, at the election of Lensplanet.com is limited to:
1. In relation to goods, the replacement or repair of the goods, the supply of equivalent goods, the payment of the cost of replacing or repairing the goods or the payment of the cost of obtaining equivalent goods; and
2. In relation to services, the supplying of the services again or the payment of the cost of having the services supplied again.
We shall not be liable for the delay or failure in supplying a product from our site as a result of being caused by events that are beyond our reasonable control. Should any such event occur, we shall endeavour to contact you as to make a decision to whether the contract of sale should remain or revoked.
CANCELLATION AND RETURNS
Cancelling an Order
We want you to be entirely satisfied with both your purchase and the service you receive from Lensplanet.com. You may cancel your order (or any items within your order) at any time up to 7 days after you have received the goods, as long as the goods are unopened, unused and are still in their original packing. You do not have to give a reason for canceling your order during this period. You will be responsible for the cost of packaging and returning your order. You will receive a full refund of your order, less a nominal charge of £4.00 within 30 days of advising us of your intent to exercise your right to cancel your order. This is the maximum period allowed by law. The actual period between cancellation and refund is likely to be significantly shorter. Please note - Items which are being returned for a full refund under your right to cancel your order should be unopened, in their original packing and should not have been used. If the products you have ordered are returned to us as undeliverable by the postal service, we will endeavour to contact you by email for confirmation of the delivery address. If no reply is received within a reasonable period and in any event within 30 days of the return of the goods, then a refund will be made within 30 days. If you don't receive your order within 14 working days of the shipment date, we will ship you a replacement.
Goods Damaged or Faulty on Delivery
You may return damaged or faulty goods within 7 days of receipt. In the unlikely event you receive a defective lens, do not throw the lens away. It may need to be returned to the manufacturer for analysis. Provided the lens manufacturer agrees the lens is defective, a replacement lens will be issued at no cost. Please note that defective lenses may only be exchanged for the exact same lens and prescription. We cannot issue refunds for defective items. Making a Return
Ensuring that our customers are 100% satisfied is of the utmost importance Lensplanet.com. If you want to cancel your order or refund or exchange because an item is faulty or damaged, please send an email to firstname.lastname@example.org with the Order number, the title and the reason for the return. We will then get back to you via email with the details of the address for making the return. Please package your return carefully to ensure your lenses are not damaged in shipment – we cannot issue credit for items damaged in transit to our office. Also, to ensure safe delivery, you should ship your package using a trackable carrier (we recommend Recorded Delivery). We are unable to issue credit for packages lost in transit to our office.
CUSTOMS DUTIES, VAT & OTHER TAXES
Please note that you may be subject to import duties, taxes and VAT levies once a shipment reaches your country. We are not responsible and have no control over these charges. Any such charges are to be borne by you, i.e. the customer.
All disputes shall be settled within the exclusive jurisdiction of the courts of Jersey.
